1. Introduction

AutosHD, Inc., doing business as create.a.motive (“create.a.motive,” “we,” “us,” or “our”), provides sales process performance analysis and sales training services to retail automotive dealerships (“Clients”). This Privacy Policy explains how we collect, use, and protect information in connection with our website at www.createamotive.com and our services.

Please read this policy carefully. By visiting our website, engaging us as a Client, or otherwise interacting with us, you agree to the practices described here.

2. Scope of This Policy

This policy covers two distinct types of information:

• Information about you — if you visit our website, work for a Client, or otherwise communicate with us directly (for example, as a dealership owner, manager, or staff member).
• Client Sales Data — sales process and performance data we access within our Clients’ own CRM systems in order to provide our reporting and training services. See Section 4.

3. Information We Collect From You

We may collect the following information directly from you:

• Contact information: name, work email address, phone number, job title, and dealership name, when you contact us, sign up for our services, or communicate with our team.
• Communications: messages, emails, or other correspondence you send us.

We do not use cookies, tracking pixels, analytics scripts, or any similar tracking technology on our website, and we do not have any payment processing systems, since we do not collect payment information through our website or software.

4. Access to Client CRM Systems & Sales Data

As part of our services, our Clients provide us with access credentials to log into their existing CRM systems. We use this access solely to review and analyze the Client’s sales process performance and to prepare performance reports and sales training materials for that Client.

With respect to this access and the data involved:

• We log into our Clients’ existing CRM software using access the Client provides to us; we do not build, provide, or assist our Clients with any technology to access their own CRM software.
• We pull sales data from a Client’s CRM into our own internal Sales Reports for the purpose of analyzing that Client’s sales process and team performance.
• We do not store detailed personal information about our Clients’ own customers (for example, vehicle buyers or prospects). Our analysis and reports focus on sales process and performance metrics, not on detailed customer records.
• We access and use this data solely to deliver our performance analysis, reporting, and sales training services to the Client whose CRM it comes from.

5. How We Use Information

We use the information described above to:

• provide our sales performance analysis, reporting, and sales training services to our Clients;
• communicate with Clients and prospective Clients about our services;
• respond to inquiries and support requests;
• maintain and improve our own internal business operations; and
• comply with applicable legal obligations.

6. No Sharing or Disclosure of Information

We do not share, sell, rent, or otherwise disclose your information or any Client Sales Data to any other person or organization, for any purpose, at any time, except as described below.

The only exception to this policy is disclosure that we are legally required to make — for example, in response to a valid subpoena, court order, search warrant, or other lawful demand from a government or regulatory authority, or where disclosure is necessary to comply with applicable law. Where legally permitted to do so, we will notify the affected Client before making any such disclosure. Outside of this narrow legal exception, we do not share information with anyone.

7. Cookies & Tracking Technologies

We do not use cookies, web beacons, tracking pixels, or any other tracking technologies on our website or in connection with our services.

8. Data Security

We use administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, or disclosure, including restricted and frequently changed access credentials, and login alerts that notify us of access to Client CRM systems. No method of storage or access is completely secure, and we cannot guarantee absolute security.

9. Data Retention

We retain Client contact information for as long as needed to maintain our business relationship with the Client. Sales Reports and any sales data we have pulled from a Client’s CRM are retained only for the duration of our engagement with that Client. Once an engagement ends, this data is permanently deleted and is not retained afterward.

10. Your Choices & Rights

You may contact us at any time to:

• ask what contact information we hold about you;
• request correction of inaccurate information; or
• request deletion of your contact information, subject to our need to retain certain records for legitimate business or legal purposes.

To exercise any of these choices, contact us using the information in Section 15. If your request relates to Client Sales Data accessed through a dealership’s CRM, we may need to direct you to that dealership, since they control the underlying customer relationship and records.

11. Additional Notice for California Residents

We do not believe the California Consumer Privacy Act (“CCPA”) legally applies to create.a.motive, since we do not meet any of the thresholds that trigger it — we do not have gross annual revenue over $25 million, we do not buy, sell, or share the personal information of 100,000 or more California residents or households, and we do not derive any revenue from selling personal information. We are including this section voluntarily, as a courtesy to California residents we interact with, and this section does not constitute an admission that the CCPA applies to us.

Consistent with the rest of this policy, California residents who contact us can ask us to:

• tell them what contact information we hold about them and where it came from;
• correct inaccurate information; or
• delete their contact information, subject to our need to retain certain records for legitimate business or legal purposes.

As stated in Section 6, we do not sell or share personal information with any third party, so there is no “sale” or “sharing” to opt out of. We will not discriminate against you for making any of the requests above. To make a request, contact us using the information in Section 15; we may need to verify your identity before responding.

12. Children’s Privacy

Our services are intended for business use by adults and are not directed to children. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can delete it.

13. United States Only

We operate solely within the United States and have no international Clients, customers, or business operations. This Privacy Policy and our services are intended only for use within the United States.

14. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the “Effective date” above and, where appropriate, provide additional notice. Your continued use of our website or services after changes take effect constitutes acceptance of the updated policy.
